Will my Auctiva store be Independant of Ebay ?

GREAT IDEA.

But I have one question.

Amongst my wares I sell Historic Law Enforcement items . Ebay deems 'truncheons' as 'illegal' according to a CA law. I have discussed this wth them regarding selling everywhere else in the US, Canada, UK, & Europe.....and cannot list , thus respecting their priveleges. My question is,.....with my Auctiva store - will I be permitted to offer LEGAL items ..even with exemptions eg NOT available in CA ?

I am attempting to ascertain if LEGAL items that can be legimately sold on your own website (but might 'disagree' with ebay) ARE permitted?

We're in California as well. We've been working with our lawyers on a list of prohibited items. Unfortunately it's likely they'll be similar to those on eBay and other sites. Perhaps if we grow bigger we can remove some from the list or make some exemptions or exceptions but at our size it's not cost effective to either police or program in such exceptions. We do this quite simply to save us the expense and time of the lawsuit and distractions they'd otherwise create for us that could take away from the overall goal of helping as many sellers as possible.

I'll try and make sure that list gets posted as soon as possible to the Auctiva Commerce site. Hopefully with the update of the site this week along with the pricing.

my ongoing argument/ discussion has been , these are NOT 'illegal' items but historic ones... WHY would a thug pay $50++ for a vintage painted truncheon when a Louisville slugger or even a piece of 2 x4 wood even a pickax handle is a fraction of the price and would suit their intentions better?

I can TOTALLY understand 'curreent' badge & security issues but some of the 'illegal' item issues are crazy.

I agree. I think the issue comes up at where to draw the line. Is a 10 year old badge vintage? I don't know. It worries me to take this question on when eBay with their billions of dollars a year in profits wont touch it. Some of it is stupidity certainly. My dad is a collector and has a vintage badge from some wild west sheriff. Obviously that is of historical and collector value and ought to be allowed. He also collects guns, which aren't allowed on eBay.

However other things come up such as Nazi war memorabilia. Perfectly legal in the US, but not the case in Germany. Those types of items used to be available on eBay but they gave in to the Germans requests that they not be allowed.

Difficult choices as I certainly don't want to push my beliefs on anyone and be the judge and jury for which items should be allowed or not.

Perhaps over time we can open this up to our seller community and let our sellers as a whole help guide our decisions as to whether to allow various types of items currently prohibited on eBay. Or maybe we have a separate section for them. To begin with though I think we'll have a similar list to eBay.

I totally agree,

one thing that surprises me... a 'WORLDWIDE' wed...INTERNATIONAL communication... and we still have 'local' issues.

I CAN understand that certain countries have certain issues ( eg Germany with Nazi items) but surely if you had your own website in CA ... offered it , and someone from Germany purchased it...it would be 'permitted' It is another issue that if the item was mailed to Germany then totally different legal issues with the Buyer. Surely it is now a global issue of selling in your own country LEGALLY but if someone KNOWINGLY tried to import an Illegal item , they are the one who should be prosecuted?

There IS a definate black/white line with legal/illegal items NO grey. if sourcing for a collection further afield ...this should be prermitted IF LEGAL ..if not you are breaking the law

The items you are refering to from German are sold in Germany every day. From web sites, auction sites, flea markets, antique stores and military shows. As long as the offensive symbol is covered they can sell them. In fact, there are numerious web sites in Germany selling these items today. As long as they are listed as historical items and are not being sold for political reasons and state so in their web sites. I believe it was the French who tried to sue Yahoo. I really find it hard to believe that legal, historical items are not allowed because of one or two countries laws. Ebay first allowed the sale of these items as long as they were not shipped to France, Germany and Italy. Do what you have to do. Oh- There are WWII German items being sold in Yahoo stores now and ebay as long as one conforms to ebays rules. Mike
