I believe all you would need to do for your listing to pass error check is to check the box for "Does Not Apply" next to the UPC field in the Category area of the lister page, which is the same option that would be checked for a used item.

If you continue to have difficulty posting your listing, please let us know the details of what you experience in a support case along with the title of the listing you have run into trouble with and we'll be happy to look into it for you.
