Hi all, I acquired a good sum of VHS tapes at 2 yard sales (free of charge) that has at most 4 movies taped from TV. I emailed ebay regarding selling these on auction as they are primarily taped for personal viewing. Since I never recieved a response from them regarding whether or not it was permissible to sell these I went ahead and placed the lot up for auction. <br>
Today I recieved a notice from ebay support that the auction was in violation of copyright laws and thus they deleted my auction. I could see if the video tapes only had one movie each, but come on...4 movies per tape?
Nonetheless, I can still see their point. I'll give them away to friends Just to let everyone know why the auction is gone. I had a bid too. lol

Um...you may have kicked a sleeping dog when you asked Ebay. Either that, or a competitor reported you.
I'm too lazy to pour through the policy right now, but there are literally thousands of tapes like this for sale. I really do not believe you were in any violation.

Actually a better place to ask (if you think you have to) is in Ebay's answer center under community...those folks are good Smile Just member to member, like this is.
Hi recording from the Tv for resale would I am sure infringe filmamker/distributer copyright in the USA as it would here in the UK.

If they were you own creations fine then you would be the copyright owner.

Srictly speaking it is actually iffy about recording anyway but this is blind eyed for later personal viewing.

You probably could have sold them as used tapes, but then how would you word it to get a sale without raising the evil eye. Considering eBay is getting a lot of corporate stick over their easy going approach "we are only a venue" from major companies now they were probably glad to have caught out small fry like yourself (no offence intended) to say we are doing something about piracy etc.

It is easy for them to 'catch' someone like yourself making a mistake than catching major fraudsters who make a fortune.

Hard luck, once again eBay's slow response netted them your insertion fees as a bonus Frown
