I am trying to list some different womens perfumes 1 item listed and 3 items showed me the following API. " API Error

eBay has not posted your item due to title, description, and/or eBay policy violation. Please contact Auctiva support for more information on why your listing has failed to post."The one that listed was for Liz Claiborne Curve. The three that did not,Estee Lauder. BEAUTIFUL EDP Perfume 1 OUNCE NIB,DAVIDOFF COOL WATER WOMAN 1.7 OZ 50 EDT SPRAY NEW NIB,Light Blue Dolce Gabbana Eau De Toilette EDT 1.7 NIB. All auctions were created with the same template and details except for the category and actual item description.I also filed a support request on this but was wondering if anyone knew anything about the error

does anyone have any information on how to cover yourself if Ebay tries to remove a listing by saying goods are counterfeit? I am positive my goods are genuine but want to be prepared if they try to remove them. I have never dealt with this issue before. I know some people place a disclaimer in the auction stating the goods are genuine and not counterfeit but to me that seems to detract from the listing! I did insert a disclaimer in my auctions but I did it in white text which blends into my template. I did this just as a safeguard against Big Brother Ebay. Here is my disclaimer"This is not counterfeit merchandise and adheres to all Ebay policy" on item number 290145823516

Hi Taz,

Don't know if this helps but from my limited understanding it may be a couple of things that get your listings pulled.

One is the copyright protection scheme on E-Bay, called VERO, that does not allow you to sell branded goods. All the major names are signed up to it and some of them are real hot-dogs when it comes to copyright/trademark issues.

Another reason is that someone may have reported your listings if pulled when running.

Final one is, a competitor may have reported you as selling fakes, to reduce the competition.

Sounds like the first to me. Pulled because of VERO regulations. Good luck in getting it sorted with E-Bay.

You are responsible. Sorry.

Any claim that a buyer makes regarding goods arriving damaged will be settled in the buyer's favour.

You can ask them to return the damaged goods by trackable means, at their expense, and either offer a refund or exchange including P&P/shipping handling costs incurred by them.

Note. The above applies to the UK site. Should imagine it's the same globally, though. That may be a violation of E-Bay rules and another reason for having your listings pulled, as well!

I'm not so sure the seller MUST accept responsibility for damaged shipments. That's what insurance is for. If they buyer purchases the insurance and the shipment is damaged they can go back to the carrier for the value. If they don't choose the insurance, the seller is not obligated to refund monies due to the failing of the carrier or the choice of the buyer to not purchase shipping insurance if it is available.

If this were the case, any buyer could simply damage an item they don't like or want and claim it as shipping damage and request a refund. That, at least here in the US, is fraud.
Ah, it's different in the UK. E-Bays rules are that the seller is responsible for the item until delivered.

If lost before reaching buyer the onus is on the seller to claim for the loss.

If it arrives damaged the buyer can claim back his money. The buyer has the option of refund/exchange.

The seller has to claim the cost of the damaged item from the carrier.

Insurance is, again, for the seller's benefit, in the UK. Not the buyer's.

So, it's that the rules are different for sellers dependent on location, it seems.

Regarding responsibility regarding damage.

One should ensure that their packing techniques will allow the item to survive the post office lunchtime 5-a side football match with thier parcel (a wonderful description from a buyer of mine).

If the item is valuable it should be posted by a signed for service with insurance. This option should be clearly shown on your listing.

Low value items i.e. <£32 keep proof of postage then that can be used to claim off the post office for loss. Damaged on arrival should be claimed by the buyer via the post office and lets face it if the item was poorly packed the claim will bounce back on you (the seller) I am sure.

Lost items involve both seller and buyers address being submitted to the post office so potential scammers on either side will get black listed by the PO.

In summary pack well (including clear printed labels for destination and from address ) and follow post office recommendations then you have met your responsibilty. It is all very well if eBay wants to say it is the sellers responsibility but failure to deliver and crushing in post office machinery be it sorting or being runover is beyond our (the sellers)control.
